Terms and Conditions

Language: This is an English translation of the Spanish (Argentina) Terms and Conditions. The Spanish version is the authoritative text and governs in the event of any discrepancy.

1. Identification of the provider

These Terms and Conditions govern the use of the site digitalizahoy.com and of the accounts created on it, offered by Marcos Ezequiel Herrera, referred to in this document as Digitaliza Hoy.

By using the site, writing through its contact form or setting up access to an account, you accept these Terms and Conditions.

2. What this site offers

Digitaliza Hoy is a development studio. This site:

• presents its services and shows examples of its work. The sector examples on display are fictional: the people, businesses and data appearing in them do not exist;
• offers a contact form for starting a commercial conversation;
• hosts the Partner Programme, governed by its own Agreement (section 6);
• gives access to a private area through the accounts that Digitaliza Hoy creates or enables (section 4).

Engaging a development service is not done through this site. Its terms are agreed in writing, separately, in each case.

3. Perfil Digital

Perfil Digital is an independent product, offered at perfildigital.io under its own terms and conditions.

Digitaliza Hoy mentions it and links to it commercially from this site, but does not provide it from this domain: it does not host profiles, does not charge subscriptions and does not keep its data. These Terms do not govern it.

4. Creating an account

The accounts on this site are created or enabled by Digitaliza Hoy for the people authorised to use the private area. There is no public registration: the site offers no form for creating an account, and nobody can create one for themselves.

When Digitaliza Hoy creates an account, it sends a link to the email address given, to set up access and choose a password. That link is single-use and expires; if it expires before it is used, a new one is requested by writing to hola@digitalizahoy.com.

An account can be entered with a password, with a linked Google account, or with both. What cannot remain is an active account with no way of entering it.

An account gives access to the private area of the site: the administration of the account itself and, for the people approved as Partners, their portal.

Digitaliza Hoy:

• does not verify the civil identity of users;
• does not request an identity document in order to create the account;
• does not warrant that the name or the information given correspond to a verified identity.

The account holder is responsible for:

• maintaining access to the email address the account was created with;
• keeping their credentials secure;
• not sharing their password or their Google account;
• reporting unauthorised access.

5. Contact form

The enquiries sent through the contact form are used to answer them and, where appropriate, to continue the commercial conversation requested. Sending an enquiry does not constitute an engagement and gives rise to no charge.

Which data Digitaliza Hoy receives through that form, and how it is kept, is in the Privacy Policy.

6. Partner Programme

The relationship between Digitaliza Hoy and a person or company approved as a Partner is governed by the Partner Programme Agreement, which is linked in the footer of every page of this site.

That Agreement adds what corresponds to the Partner role and does not replace these Terms or the Privacy Policy.

7. Use of the site

Whoever uses the site or an account undertakes:

• not to use them for unlawful or fraudulent purposes;
• not to impersonate others;
• not to infringe the rights of third parties;
• not to interfere with the security or the operation of the site;
• to send only their own information, or third-party information they are authorised to communicate.

8. Deletion of the account and personal data

Deletion of the account is requested by writing to hola@digitalizahoy.com.

There is currently no automatic deletion button. The request is processed manually, after reasonable verification that the person making it controls the account.

Deletion may include:

• anonymisation of the email address;
• invalidation of the password and of the link with Google;
• deactivation of the account;
• deletion of the sessions and of the pending links associated with the account.

Certain records may be kept where this is necessary for legal obligations, reconciliation of the Partner Programme, auditing of internal access, evidence of requests or protection of rights.

Deletion at Digitaliza Hoy does not necessarily mean that the email provider deletes the information it keeps under its own policies or obligations.

9. Availability of the service

Digitaliza Hoy endeavours to keep the site available, but does not warrant that it will operate uninterrupted or free of errors.

The service may be affected by:

• maintenance;
• technical failures;
• provider problems;
• security incidents;
• causes beyond the reasonable control of Digitaliza Hoy.

No clause of these Terms limits non-waivable rights recognised by Argentine legislation.

10. Suspension or termination for breach

Digitaliza Hoy may suspend or terminate an account where:

• these Terms are breached;
• the service is used for unlawful purposes;
• there is fraud or impersonation;
• the rights of third parties are infringed;
• there is a risk to the platform or its users;
• it is necessary in order to comply with a legal order.

Where reasonably possible, the measure and its reason will be communicated.

11. Intellectual property

The software, general design, code, visual identity and the site's own components belong to Digitaliza Hoy or are used with authorisation.

The person retains the rights that correspond to them over the information they send through the contact form or upload to their account, and authorises Digitaliza Hoy to store and process it to the extent necessary to provide the service.

12. Changes to the service or to these Terms

Digitaliza Hoy may update these Terms for legal, technical or commercial reasons.

Relevant changes will be communicated by a reasonable means before they become applicable.

No service will be charged for without the information and acceptance legally required.

13. Communications

Communications relating to security, the account or privacy may be sent to the registered email address.

The links sent by email are single-use.

Currently:

• the link for setting up access to an account is single-use and expires; the period is stated in the same email that sends it;
• password recovery lasts one hour.

Consumers may also turn to the competent consumer protection authorities.

15. Applicable law and jurisdiction

These Terms are governed by the laws of the Argentine Republic.

In consumer relationships, the competent jurisdiction will be the one corresponding under the applicable rules and the consumer's domicile.

For relationships that are not consumer relationships, the parties submit to the ordinary courts of Tucumán, unless a mandatory rule provides otherwise.
